When a Construction Project Goes Wrong

Louisiana Unfair Trade Practices Act (LUTPA)
The
Louisiana Unfair Trade Practices Act (LUTPA) prohibits deceptive or unfair conduct in business transactions.
This includes:
- Misrepresentation of services or qualifications
- Deceptive sales practices
- Unfair or unethical conduct during a project
In certain cases, if the contractor continues deceptive conduct after notice, the court may award
three times actual damages, along with
attorney fees and costs.
Contractor Fraud Claims
When a contractor takes payment and fails to perform, the law provides both civil and potential criminal remedies.
Fraud may be inferred where a contractor:
- Fails to begin work within a reasonable time (often 45 days)
- Uses deception to obtain the contract
- Lacks the required license for the work
In these cases, recovery may include
full restitution, including the cost to repair defective work and complete the project.
Unlicensed Contractor Violations (2026 Update)
Louisiana law imposes strict requirements on contractor licensing.
For example:
- Roofing projects over $7,500 require proper state licensing
- Unlicensed contractors may face fines or criminal penalties
- In some cases, they may be barred from recovering payment and required to return funds

Breach of Contract and Dissolution
Where work is incomplete, delayed, or defective, homeowners have the right to pursue claims under the Civil Code.
